Gujarat High Court on Monday passed an order that Ahmedabad district collector has no power to suspend licence of Cinepolis Multiplex. The court was hearing a petition filed by Cinepolis India Pvt Ltd, challenging the one-month suspension of its licence.
The collector had suspended the licence after receiving complaints from Vastrapur residents that movie shows ran beyond permissible time.
Earlier, Justice S R Brahmbhatt had asked the authority to explain if it can suspend licence under the Cinematograph Act without criminal complaint or conviction as per the provisions of section 7 of the Act.
Government pleader Prakash Jani contended that the power of revocation or suspension of permission is independent, and in any case of violation of norms, the collector can exercise it. Government, he argued, acted after receiving complaints from neighbouring residents.
