Gandhinagar: In a development that could benefit over a lakh state employees, the Gujarat high court on Friday directed the Gujarat government to modify its scheme for hiring on fixed-pay scales and to produce a notification within a month.
Acting on a PIL by an NGO, Yogkshem Foundation for Human Dignity, challenging the hiring policy for class III and IV employees, a bench of acting Chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala held the present policy of the state government as violative of Constitutional provisions and exploitative in nature. The HC has asked the government to restructure the pay package, which will result in an extra financial burden amounting to around Rs 350 crore on the government coffers.
On October 6, 2011, chief minister Narendra Modi raised the fixed pay of these employees calling it a pre-Diwali festival “gift.” A senior finance department official said that there would be “around 40 per cent rise in the fixed pay received by employees”, which include vidya sahayaks, who currently get a fixed pay of Rs 4,500 per month; police lok rakshak constables who get Rs 5,300; education sahayaks (lecturers) who get Rs 10,000; and administrative sahayaks (clerks) receiving Rs 9,400.
“There are about 1.5 lakh fixedpay employees,” the official said, adding, “The high court order doesn’t make it obligatory on us to pay dearness allowance, house rent allowance or leave travel allowance.” He said the court had ordered the implementation of the lowest Sixth Pay Commission grade for each of these employees.
“There is no question of making them permanent before their five-year term as fixed-pay employees ends,” the official said.
Disagreeing with the interpretation of the state finance department, senior state employees’ association leader Vishnu Patel said that fixed-pay employees should get dearness allowance, house rent allowance, leave travel allowance among others.
