Gujarat High Court on Thursday passed a judgment that the Shreemati Nathibai Damodar Thackersey Women’s University has no jurisdiction to affiliate any college outside Maharashtra. Hence, the state government should not grant permission to colleges within the state seeking affiliation to SNDT.
A division bench headed by Chief Justice S J Mukhopadhaya observed that it can be seen from various provisions of the Act of 1994, including Sections 6(1) and 105(2) of the Act of 1994 that SNDT University can exercise its power within the territorial limits of the State of Maharashtra.
The court had earlier issued a notice to the Advocate General of Maharashtra and Advocate General of Gujarat in a case concerning the issue of affiliation of a college in Gujarat with a university outside the state.
The court was hearing a petition challenging the action of state government in not granting No Objection Certificate (NOC) to a college for opening a self financed Physiotherapy College having affiliation with a university which is not situated within the State of Gujarat.
On May 13, 2009, the petitioner was granted affiliation with the North Gujarat University. Thus, the petitioner then informed the govt that the petitioner is not interested in an affiliation with the North Gujarat University.
