New Delhi: The Supreme Court on Thursday sent auditors S Gopalakrishnan and V S Prabhakar Gupta back to jail nearly 10 months after they came out of prison on bail in the Rs 7,000 crore Satyam accounting fraud case.
Though most of the key accused, including former chairman of Satyam Computers B Ramalinga Raju, were lodged in jail, these two were granted bail by the Andhra Pradesh High Court on June 25 last year.
Allowing CBI’s appeal, a Bench of Justices P Sathasivam and B S Chauhan said the HC ought not to have granted bail to the two accused because of the specific allegation that they were party to the criminal conspiracy to show inflated cash and bank balance for several years.
The bench also took into consideration the apex court’s October 26, 2010 order cancelling the bail of Raju and other accused.
The SC, while cancelling Raju’s bail, had directed the trial to be concluded by July 31, 2011. It said because the trial was to be concluded within a specific period, the HC had erred in granting bail.
The SC bench said, “Gopalakrishnan and Gupta being external and internal auditors respectively, their role being paramount in inflating assets and bank balances of Satyam Computers, the HC is not justified in granting bail.”
