Ahmedabad: The Gujarat high court on Thursday restricted the arguments of counsel for the police officers who are made respondents in the Sadiq Jamal encounter case.
Justice MR Shah restrained advocates of PP Pande and DG Vanzara, who wanted to argue on the maintainability of Sadiq’s brother Shabbir’s petition and their alleged roles in the encounter. The lawyers were not allowed to address the court with regard to whether the encounter was genuine or fake. This happened after the court questioned their locus standi in this case at this stage and petitioner’s advocate Mukul Sinha raised objection to accused cops’ role in the proceeding. The petitioner has sought to register an FIR against the crime branch cops involved in Sadiq’s encounter and the case to be probed by CBI.
Pande’s counsel, JM Panchal argued that the petition cannot be entertained because the petitioner has got alternative remedy by approaching a magisterial court with his complaint.
