Ahmedabad: The Gujarat high court has transferred a divorce case from a Vadodara court to Rajkot acting on the petition filed by a woman. The court observed that it was difficult for a woman to travel alone and more so when the distance to be traveled is long.
Vadodara’s Chintan Shah had filed a divorce suit against his wife Sweety Bhupendrabhai in Vadodara’s family court in 2009. On the other hand, Sweety had instituted a maintenance suit for herself and their seven-year child in Rajkot. Moreover, the woman had also lodged a criminal complaint against her husband, and the proceeding for the same is going on in a Rajkot court.
To attend divorce proceeding in the court, Sweety has to regularly visit Vadodara. She moved HC urging the transfer of the case to Rajkot on the ground that traveling some 225 kilometre leaving her child and ailing father behind was getting difficult. She also contended that since her husband has to come to Rajkot to attend the proceeding of maintenance suit and criminal case, shifting the divorce proceeding also to Rajkot would spare her from the unnecessary trouble.
After hearing arguments from both the sides, Justice KS Jhaveri ordered to shift the divorce case to a Rajkot court.
