Mumbai: The Bombay high court on Thursday askedthe CBI to probethecase of key missing files relatedtotheAdarsh Housing Society and find out where members got the funds invested in the controversial Colaba condominium. The investigations are currently being done by Mumbai Police.
A bench of Justices B H Marlapalle and U D Salvi observed that a retired
bus conductor or a driver from remote Maharashtra were unlikely members of the controversial 31-storey south Mumbai highrise and said that flats in their namescouldwellbebenami.It askedCBI to invoke the Benami Transactions (prohibition) Act in the case.
The bench asked CBI to file a supplementary FIR under the law aimed at preventing an unnamed owner from enforcing any rights over the property and sought a progress report in three weeks.
Files containing crucial coastal zone approvals and deletion of a road opposite the residential tower went missing last November and police had registered a case. A PIL sought a CBI probe into the missing files.
