Ahmedabad: The Gujarat high court has stayed implementation of a lower court order directing the Jan Sangharsh Manch (JSM) to give a copy of the application made by the Manch before the Special Investigation Team (SIT) to the accused of the Naroda Patia and Naroda Gam riot cases. The court was acting on a petition filed by JSM convener Amirsh Patel.
The designated court had earlier this week directed that the copy of the application be given to the accused.
About 95 people had died in Naroda Patia during post-Godhra riots in February 2001. Forty-eight people have been arrested in the case.
In an application to the SIT on June 17, 2009, JSM had sought further investigation into the post-Godhra violence in Naroda Patia. The petitioner submitted that the application to SIT, filed by JSM and a victim Dildar Sayyad, was being investigated by SIT. It was submitted that the accused had no right to ask for the complaint or even cross-examine Dildar.
