Ahmedabad: Trouble for CG Road shopkeepers has begun in earnest now. The Gujarat high court (HC) on Monday lifted the stay order that restricted the Ahmedabad Municipal Corporation (AMC) from going on a major sealing drive on this prime market zone.
The HC refused to grant further protection against the AMC’s action against buildings that violate parking and construction norms. For the past two months, the shop keepers’ associations of CG Road have been seeking time from the HC to find plots to create parking facilities, which is lacking in the existing buildings.
On Monday, the counsel representing businessmen told the HC that they had identified two plots and communicated to the AMC evincing interest to purchase them. The price was Rs 30 crore, but the association could gather only Rs 1.5 crore. The lawyer sought further time, but the bench headed by Chief Justice SJ Mukhopadhaya was reluctant to grant it.
The judges observed that the court cannot keep extending deadline on the excuses. The HC will ultimately hear their petitions seeking the AMC to be restricted from sealing buildings on merit. However, the AMC will continue to act as per the law.
The HC has taken up the issue of implementation of building by-laws after Shivlal Purohit and Deepal Kothari through advocate Amit Panchal filed petitions in this regard. Their PILs claimed that the HC had been issuing various directions for proper implementation of norms for parking, traffic, constructions etc. since 2000, but the authorities had never paid heed to them. Hence, the court should ask the authorities to follow the directions issued earlier.
